1. This site is strictly for the use of people of the age of 18 or over. By registering and your continued use of our site you confirm that you are 18 years of age or over.

2. Entertainment Purposes Only: Any information, services offered of a healing, psychic and paranormal nature, which are communicated on or through the site is done so with the purpose of advising and helping and is for Entertainment Purposes Only.

a) They are not to be used as a substitute for any current or future medical treatment, legal advice or financial assistance you may require.

b) You should always consult your doctor for advice or treatment, lawyer for legal assistance, or financial advisors for financial advice you may require.

c) We give no assurance concerning the validity, accuracy or possibility of any and all information acquired on the site whether through a public or private service of the site.

3. For all members without Readers status: you are ONLY allowed to give readings in Forum or during our open reading events or classes. You are NOT allowed to read in Private Message via Chat UNLESS you have the permission from Site Owner or Admin. If you wish to read in Chat outside the reading events, please consider becoming a Reader. Contact Admin if you are interested in becoming one.

4. Your Username: choose a username that is NOT offensive, vulgar, obscene, sexually suggestive or in any other way inappropriate. Website links or email addresses are not permitted to be used as your username or as part of your signature. We strongly advise all members to stick with your username you’ve chosen. If a change is necessary, please inform Admin.

5. Account usage: you are responsible for your own account.

a) No multiple usernames and that your password is kept confidential.

b) You agree to never give your password to another member, for your protection and for validity reasons.

c) You agree to NEVER login and/or use another member’s account for any purpose in Forum and Chat.

d) If for any reason you suspect that your username & password has been disclosed to or obtained by another party you should contact us immediately. Please note that we never contact members by email requesting them to confirm their username & password or other details.

6. It is your sole responsibility to ensure that the email address you provide to us is current and accurate. You agree to notify Admin by PM in Chat whenever your email address changes. We are not responsible for loss of messages and other consequences if you do not provide an accurate and current email address.

7. Site Owners and Admins have full access of all members’ accounts, including information you provided upon registration. We have the ability to login/access you account and may do so – at any given time, in our sole discretion, without notice, for various purposes – including, without limitation: trouble shooting problems, edit usernames, passwords, avatars, signatures, edit/delete/ move/sync posts in Forum.

8. Site Owners and Admins reserve the right to use the email address you provide to us for various purposes, including, but not limited to: communication from Site Owners and Admins to you, Events/Classes announcements and compliance updates/notices.

9. Email messages sent by us to you will be deemed received by you when sent by us to your email address as shown on our records, at the date and time sent by us regardless of when or if such email is actually received by you. We accept no responsibility for any email messages not received by you, or for any delay in the receipt or delivery of any email notifications.

10. Confidentiality and Nondisclosure: You agree that you will treat all communications sent email or PM in Chat, from Site Owners and/or Admins to you as Confidential Information and shall not be disclosed to a third-party without a written consent from us.

11. Discussing, offering or asking for any goods or materials which illegal or would infringe on laws relating to the countries involved is forbidden. This may include – not limited to:

a) Materials which are invasive of confidentiality or the privacy rights of others, infringe on any of the intellectual property rights, abusive, hateful, harassing, vulgar/sexually-oriented, threatening, unlawful, harmful, obscene, indecent, libelous, profane, defamatory, racist, or in any other way inappropriate or objectionable.

b) Materials which are meant to cause incitement, to commit or promote a crime. This includes expressing interest in buying, selling, or promotion of using illegal drugs, weapons, hacking, pirated software/movies/music or promoting or encouraging violence of any kind.

12: As a user you agree not to do any of the following:

a) Abuse, harass, threaten, stalk, defame or in anyway seek to violate the rights of another user or third party.

b) Use or harvest data provided by other users in a way that they would object to.

c) Use data provided by other users for purposes other than contacting them via the Forum or Chat.

d) Contact other users in ways they may find inappropriate.

e) Encourage illegal activity or activity that violates the rights of other Forum users or third parties, whether individuals or organisations.

f) Supply or post Content calculated to deliberately mislead other users or third parties, including Content falsely made to appear from or be endorsed by us.

g) To pose as another user, third party or our representative for the purposes of obtaining user or third party information.

h) To transmit or transfer any viruses, trojans, worms or any other malicious programs or code intended to spy on, gain control over, disrupt, destroy or in any other way impair any computer hardware or software or any other equipment.

i) Attempt to gain access to our servers or other equipment in order to disrupt, impair, overload or otherwise hinder or compromise the safety, security or privacy of any of the services provided by or relied upon by us and other users.

j) Reframe or repurpose the Forum and/or Chat or any Content on it or remove or obscure any notices or advertising provided by us on the Forum and/or Chat.

13. No self-harm or threatening to commit suicide in Forum or Chat: please understand that no-one here is qualified to deal with this. We support many members who have experienced such a tragic loss and are grieving. If you are considering suicide please consult with a medical professional immediately, i.e. Help Lines or Suicide Hotlines.

14. You remain solely responsible for the content of your posts, comments, and messages. You agree to indemnify and hold harmless this site. We also reserve the right to reveal your identity (or any information we have about you) in the event of a complaint or legal action arising from any information posted by you.

15. Removal of your content: you agree, in order to ensure the comfort and safety of all members, we may edit and/or remove any your posts, comments, block or disable posts/replies in Forum and Chat, at any time as we see fit.

16. We do not take responsibility for any material or information given or received through the site. All the material and information i.e. text, photographs, graphics, emails, whether openly or confidentially transmitted are the sole responsibility of the individual or individuals that the said material and information originated from.

17. Disruptive behavior is not acceptable this includes behaving in a drunken, angry, vengeful or sexually provocative way is not acceptable. We may, in our sole discretion, kick, remove or ban, any member’s access to our site without notice. (See Suspension and Termination section)

18. All form of communication/conversation made through this site should be considered viewable by us. All Private Messages, whether ‘deleted’ or not, are stored on the server and may be reviewed if we feel we have cause for an investigation. If you do want to keep something private, do not use our services for transmitting it. Situations involving investigations can be anything at our discretion, for example, to investigate specific incidents of our services being used for racism or harassment.

19. Advertising: it is not acceptable to use Paranormal Cafe as a platform to advertise your services without receiving prior written permission of the Site Owner or Admin.

20. Taking Members off site to read: this is not acceptable. For the safety of our members, it is crucial all readings are done so on PC’s platform to allow us to monitor readings for legal and safety purposes.

21. No recruiting/poaching: recruiting our members with invitations to join other websites, forums/groups, personal or otherwise. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also forbidden.

22. Your confidential information: you understand and are in agreement that due to the sites services being provided over the internet we cannot assure that your confidential information will not be illegally seized by any third party. You also understand and are in agreement that we are also bound by law to give over any confidential information you have supplied us to the police or other government bodies if requested by them to supply such information.

23. Our limited liability: our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct, indirect or consequential loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise – including, without limitation, any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings.

24. Indemnity: we assume no responsibility for the content of any material submitted to the site. Observance to copyright laws is assumed and is the exclusive responsibility of the individual providing the material. By registering you consent to indemnify that PC and its employees, owners, representatives, licensees, administrators and associates are secure from any claim or demand, as well as reasonable legal representation fees, made by any third-party due to your use of the site, arising out of material you post, tender or convey through the site, your breach of the Guidelines, Terms & Agreement including the breach by you the user of the rights of other members/users.

25: Suspension and Termination:

a) We may, in our sole discretion, kick, put a temporary ban, or terminate any member’s access to our site without notice, for any conduct we believe is in violation of any applicable law, is inconsistent with our Guidelines, Terms & Agreement, or their purpose, or is otherwise harmful to the interests of PC and/or our community.

b) We are not obligated to provide you with any of Your Content used in connection with the Paranormal Cafe online community platform after termination nor do we obligate you in giving the reasons for termination.

c) Upon termination, we are not obligated to remove your content within our platform, including but not limited to: your account’s username and profile picture, your posts and comments made by you in Forums or in Chat. You may request for your persnal data to be removed from the site, please see Personal Data and Privacy section below.

d) Personal Data and Privacy: You may request your personal data to be deleted. The only personal data we store on our database that falls under US law is your email address provided to us upon registration associated with your username & account.

e) Personal Data Removal request has to be done in writing to Admin via PM in Chat. We shall complete the process within 30 days, but it may take up to 90 days from the date of your request in PM.

f) Deleting Account: We do not delete Members Accounts as this could create confusions when different people joining the site using previously deleted account username. We do however offer to deactivate accounts to people who feel they no longer wish to be members. To deactivate your account send a PM in Chat to an Admin requesting deactivation.

26. You agree that PC’s Guidelines, Terms & Agreement shall survive account inactivity, suspension and/or termination of your membership.

27. Infringements: any infringements of Guidelines, Terms & Agreement should be reported immediately to Admin.

28. Law and Jurisdiction: this Terms & Agreement and the association you and PC will be governed by the laws of the United States of America without regard to its conflict of law provisions;

a) You are in agreement to submit to the personal and exclusive jurisdiction of the courts located within the United States of America.

b) The failure of PC to exercise or enforce any right or provision of the Terms & Agreement shall not constitute a waiver of such right or provision.

c) If any provision of the Terms & Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms & Agreement remain in full force and effect.
